Even within the "Killing Capital" of death penalty, the U.S.A. they hold Death Row prisoners for up to 10+ years before the sentence is finally carried out. There is a window or error but there is also at least in this country incredibly weak sentencing for violent/drug/sex offenders. A return to something potentially viewed as Medieval is a deterrent and if it isn't, for these people it wouldn't matter.
If somebody had brutally raped a family member and had previous convictions for similar offences, hell even a first time offense. If the law doesn't sort it out the community will.
The point comes down to what the people want, need and demand from the legal end of the nation. Right now it's failing spectacularly. More prisons, more garda (and better working conditions/pay for them) and harsher sentences. People with "Life" sentences getting let go after 7-12 years on parole? **** ing joke..
